The decision of Catalonia High Court of imposing 25% of Spanish in Turó del Drac school of Canet de Mar becomes final

Breaches:



In 2021, Catalonia High Court of Justice imposed a 25% of Spanish language in Turó del Drac school of Canet de Mar after an appeal lodged by some parents of students of the school. The judgment finds that the content of Spanish in the school can’t be considered as “adequate” and that it is necessary to adopt the “suitable measures” to guarantee the right of the student to receive an education in Spanish. In addition, it finds that the case can be solved without submitting a question of unconstitutionality, since it is an individual situation. Nonetheless, the Constitutional Court has not reached a decision on the question of unconstitutionality submitted by the same High Court, when it found that the rules passed by the Government of Catalonia on Catalan as vehicular language and Spanish as curricular prevented the enforcement of the 2020 judgment that imposed 25% of Catalan in schools in Catalonia.
