Breaches:
The councillor of Capgirem Vic-CUP was being investigated for an alleged crime of incitement to sedition. Joan Coma defended the disobedience as part of the municipal plenary session’s vote on a motion in support of the declaration of dissolution on 9 November 2015 approved in the Parliament of Catalonia. The court does not see that ‘a proposal was made to the citizens to participate in a disorderly public uprising,’ one of the essential requirements of the crime of sedition. Nonetheless, the National HIgh Court judge Ismael Moreno refers the case to a Vic Examining Magistrate’s Court to investigate whether there was a possible crime of prevarication or disobedience. On 20 June, the Vic court shelves the case.
