The Provincial Court of Barcelona orders a repeat trial against the five members of the Electoral Commission of 1 October

Breaches:



On 14 April 2021, the Criminal Court no. 11 of Barcelona acquitted the five members of the Electoral Commission of the 1 October (Jordi Matas, Tània Verge, Marta Alsina, Marc Marsal and Josep Pagès) of the crimes of disobedience and abuse of power. However, the Provincial Court accepts the appeal filed by the Public Prosecutor, cancels the sentence and orders the trial to be repeated. The Court considers, among other things, that there has been no assessment or comparison of evidence relevant to the judgement. It also indicates that the court will have to reconsider its own competence with respect to Tània Verge, given her status as Minister of Equality and Feminism of the Government of Catalonia and whether to send a reasoned statement to the High Court of Justice of Catalonia only with respect to her or the other defendants.
