Breaches:
The Examining Magistrate’s Court no. 4 of Amposta had ordered the case to be thrown out, among other reasons because the injured man had not provided information that could allow the officer to be identified. The Court argues that the right not to be subjected to inhuman and degrading treatment requires a diligent and effective investigation. The court also finds that the case had been dismissed too soon.
