Breaches:
Once the Criminal Code reform that suppresses the crime of sedition and amends the crime of embezzlement is in force, the Second Chamber of the Supreme Court reviews the sentences of the leaders of the 1 October independence referendum leaders convicted to prison sentences. The pardon to the convicted was partial, just as regards the prison sentences, and not the disqualification sentences. The Chamber, chaired by Manuel Marchena, suppresses the sentence of sedition to all of them and applies the crime of sedition just to Jordi Cuixart and Jordi Sànchez and the rest, the crime of disobedience, following Llarena’s criteria for Puigdemont, Comín, Ponsatí and Puig. Therefore, the sentences of disqualifications are terminated for the leaders that were not sentenced for the crime of embezzlement: Cuixart, Sànchez, Rull, Forn i Forcadell. In addition, despite the amendment of the crime of embezzlement, Marchena maintains the same disqualification sentences of Junqueras, Romeva, Turull and Bassa, as he considers that in the organisation and holding of the 1 October Catalan independence referendum there was a profit motive.
