Carla Costa is sentenced to a year in prison for protesting against the conviction of the 1 October referendum leaders

Breaches:



Girona Criminal Court num. 5 sentences her to a year in prison for her participation in a march on the train railways, on 14 October 2019. The court sentences her to the crime of public disorders. The judgment underscores that video footage: proves how the accused leads a mass that walk over railways”. The Prosecutor’s Office accused her of aggravated public disorders and requested 2 years and 6 months in prison and ADIF requested 34,000 euros in damages. The judgment, however, does not sentence her to the aforementioned damages, since it considers that it is not proven that the young woman took part in the damages of the AVE railway. Investigating proceedings started alongside two other colleagues, who were also considered the promoters of the protests, but in the end proceedings continued just in her case. Costa had been involved in criminal proceedings before, in the case of the AVE blockade in Girona ‘21 Raons’, because of that, she assures that the Mossos d’Esquadra already knew her. Her support group announces that is preparing an appeal against the judgment. They consider that it entails a criminalisation of the right to protest that she is sentenced for walking over the train railway, facts that the judgment considers peaceful.
