David Madí’s defence calls for the overturning of the intervention in his communications in Volhov operation on the grounds that it is a prospective investigation

Madí argues that the Civil Guard and the judge Joaquín Aguirre authorised the interception of his mobile phone without having ‘a single objective and concrete piece of evidence’, disregarding the essential rules of proceedings and violating the fundamental right to secrecy of communications. In the same resolution, Aguirre also agreed the intervention in communications of Xavier Vandrell and Xavier Vinyals’ mobile phones. The defence bases the appeal on the Prosecutor’s Office opposition to the decision and the Constitutional Court and the European Court of Human Rights case-law.
