Breaches:
The leader of the ERC has appealed the European Court’s decision to remove him from office pursuant to the Supreme Court’s ruling to disqualify him on account of his conviction in the 1 October case, despite his sentence being issued while he was still a Member of the European Parliament without requesting that his immunity be lifted. The European Court rejected the appeal on the grounds that the European Parliament does not have the power to challenge the decision of the Spanish authorities. The Court is also set to dismiss three other appeals lodged by Oriol Junqueras against the Parliament’s decisions not to protect his immunity and to replace him with Jordi Solé. Junqueras will appeal all these decisions before the EU Court of Justice. In December 2022, the European Court of Justice dismisses the appeal against this decision.
