Breaches:
Investigating Court num. 1 of Barcelona judge Joaquín Aguirre, that is currently investigating Operation Volhov, declines jurisdiction in favour of Central Investigating Courts num. 6 of the National High Court, upon the latter’s request. Manuel García-Castellón is the Court’s magistrate, that has also carried out the pre-trial stage of other cases of persecution of the independentist movement, such as Operation Judas or the case of Tamara Carrasco. The defences and the Prosecutor’s Office appeal against Aguirre’s decision, since they consider, inter alia, that the grounds of the request of the Central Investigating Court number 6 were not communicated to the parties and that the National High Court does not have jurisdiction to investigate the events of the Tsunami Democràtic, as the judge has found that they could be a crime of public disorders. Nonetheless, the Provincial Court of Barcelona will later uphold the decision.
