The Constitutional Court orders an investigation into the case of photojournalist Sira Esclasans, injured by the police during the protests following the Supreme Court ruling

Breaches:

The court overturns the Provincial Court of Barcelona’s decision to uphold the dismissal of the complaint the photojournalist filed after having been injured by a hard-foam projectile on 16 October 2019, during the protests over the conviction of the leaders of the 1 October 2017 referendum. The Constitutional Court finds that her right to effective judicial protection had been violated when the lower courts uncritically accepted the Mossos’ investigation, and returns the case to the examining magistrate’s court so that the events can be investigated.
