Breaches:
The Supreme Court dismisses the appeal of the Prosecutor’s Office against the sentence of the Provincial Court of Barcelona that acquitted CDR activist Tamara Carrasco for the crime of incitement to public disturbance. Tamara Carrasco had already been acquitted in the first instance. It is unusual for the Prosecutor’s Office to appeal an acquittal already confirmed on appeal. The first speaker, magistrate Ángel Hurtado, wanted to condemn Carrasco and, being in the minority, the speaker ended up being Javier Hernández. The president of the Chamber Manuel Marchena, Antonio del Moral, Julián Sánchez Melgar, Pablo Llarena and Vicente Magro vote against the acquittal. The dissenting vote consider that the appeal of the Prosecutor’s Office should have been accepted and that Carrasco should have been sentenced for the crime of incitement to public disorders. In July 2023, Tamara Carrasco will file a complaint of state liability for the time she spent without being able to get out of the town of Viladecans under the orders of the National High Court.
