The Court of Justice of the European Union declares that Puigdemont, Comín and Ponsatí can recover their immunity as a precautionary measure

In this way, the CJEU annuls the decision of the General Court of the European Union of July 2021 not to grant precautionary measures to Puigdemont, Comín and Ponsatí understanding that there is no risk of them being arrested. The court considers that, firstly, the fact that an MEP can be detained while waiting for the decision on his extradition can cause him irreparable damage. Secondly, the CJEU considers that, at first glance, the conduct of the president of the Legal Affairs Committee of the Parliament, Adrián Vázquez of Ciudadanos, demonstrates a personal bias or prejudice against Puigdemont, Comín and Ponsatí. The CJEU makes a similar consideration towards the rapporteur of the report, Angel Dzhambazki, who belongs to the same group as VOX in the Eurochamber.
