Breaches:
The Court considers that the granting of the third degree status to the prisoners of the 1 October case is premature. Bassa and Forcadell, who, unlike the rest, did not have a suspended third degree status, must return to prison. The Supreme Court also annuls the flexible regime of article 100.2 to which Junqueras, Romeva, Turull, Forn, Rull, Sànchez and Cuixart had been subject, as it did in the case of Carme Forcadell in July, on the grounds that the programmes ‘of treatment’ adhered to by the prisoners have no connection to the crimes for which they have been convicted. Bassa maintains the flexible regime of 100.2 because it has already been endorsed by the Provincial Court of Girona.
