Breaches:
The plenary session of the Constitutional Court dismisses the appeal for protection presented byOriol Junqueras against Judge Pablo Llarena’s decision to keep him in pre-trial detention in December 2017, when he was ERC’s candidate for president of the Government of Catalonia, and against the decision of the Criminal Chamber of the Supreme Court to uphold the measure in January 2018, when Junqueras was an elected member of the Parliament of Catalonia. Three Constitutional Court judges (Fernando Valdés, Juan Antonio Xiol and María Luisa Balaguer) dissent, arguing that the restriction of the right to political representation that the detention entailed was not sufficiently justified and that the appeal therefore should have been granted.
