The European Court of Human Rights declares that Arnaldo Otegi’s right to a fair trial was denied

Breaches:



The ECHR considers that in the trial against Arnaldo Otegi and five Abertzale leaders for the Bateragune case, the defendants’ right to a fair trial was violated due to the lack of partiality of the National High Court judge who sentenced them to prison sentences that they had already served. Strasbourg has condemned Spain for not attending to the recusal for partiality submitted by those affected but considers that the mere confirmation of this violation of Article 6 of the European Convention on Human Rights is ‘sufficient satisfaction’ and has rejected imposing a fine to the Spanish State or any other measure in favour of the victims.
