The State Attorney’s Office asks the Supreme Court to allow Junqueras to go to the European Parliament but also calls on it to request a waiver of his parliamentary immunity

Breaches:

Following the 19 December Court of Justice of the EU rulingestablishing that Oriol Junqueras has been an MEP with immunity since the European Parliament election results were announced, the State Attorney’s Office issues its opinion on how to apply the ruling. It finds that Junqueras must be allowed to take up his seat as an MEP and that the Supreme Courtmust ask the European Parliament to waive his immunity in order for its sentence in the case against the leaders of the 1 October referendum to be enforced. The Prosecutor’s Office, meanwhile, calls for the sentence to be enforced directly and for Junqueras to be disqualified as an MEP.
